These Terms & Conditions (“Terms”) govern your use of the services provided by Creative 360 Pro (“we,” “us,” or “our”). By accessing or using our website and services, you (“Client”) acknowledge that you have read, understood, and agree to these Terms. If you do not accept these Terms, you are not authorized to use our services.

No Refunds and No Guarantees

Creative 360 Pro has a strict no-refund policy for all services rendered. Once work has commenced, payments made are final and non-refundable under all circumstances.

Creative 360 Pro does not guarantee specific results, rankings, or outcomes. The effectiveness of SEO and digital marketing services depends on multiple variables, including but not limited to the existing state of your online presence, work completed by previous agencies, industry competition, and external factors beyond our control.

SEO and digital marketing are long-term strategies. Tangible results such as improved rankings, increased traffic, and higher call volumes typically require consistent effort over a minimum of six months. Clients starting from ground zero may experience longer timelines before seeing measurable results.

Six-Month Contract Commitment

All services provided by Creative 360 Pro require a minimum six-month commitment. This commitment is essential for the strategic execution of long-term campaigns.

Contracts cannot be canceled or terminated before the completion of the six-month term. Early termination requests will not be accepted, and Clients remain obligated to pay for the full six-month term, even if services are discontinued.

Contracts will automatically renew at the end of the six-month term unless the Client provides written notice of cancellation at least 30 days prior to the renewal date.

If the Client engages a third-party marketing agency, consultant, or similar service provider during the contract period, it will not affect the terms of the agreement with Creative 360 Pro. The Client remains financially responsible for the full contract amount, and no refunds or cancellations will be permitted. Creative 360 Pro is not responsible for any loss of performance, marketing disruption, or diminished results caused by third-party interference.

Document Signing and Record Keeping

All agreements are documented and signed electronically via platforms such as DocuSign. By signing the agreement, the Client confirms their acceptance of these Terms, including the Cancellation and Refund Policies.

Creative 360 Pro maintains records of all agreements and contracts for compliance and future reference.

Payment Terms and Disputes

Clients are required to resolve all payment disputes directly with Creative 360 Pro. Initiating chargebacks or reversing payments through banks or payment providers is strictly prohibited. In the event of a chargeback, Creative 360 Pro reserves the right to terminate services immediately and pursue legal action to recover funds, including additional costs and legal fees.

Monthly payments are automatically charged throughout the contract term. If the Client fails to fulfill payment obligations, Creative 360 Pro reserves the right to suspend or terminate services until outstanding payments are resolved.

No Liability for Results

SEO and digital marketing involve dynamic processes influenced by multiple factors, including search engine algorithm changes and competition. Creative 360 Pro is not liable for specific business outcomes, including but not limited to rankings on search engines, traffic increases, or revenue generation.

Results may be delayed or impacted by existing technical or structural issues with the Client’s website, previous work done by other agencies, and market competition.

Client Responsibilities

The Client must provide accurate, complete, and up-to-date information necessary for the successful execution of services.

Clients are expected to respond promptly to requests for approvals, content, or feedback and provide all required materials (e.g., images, logos, copy) in a timely manner.

To ensure the best results, Creative 360 Pro recommends working exclusively with one marketing or SEO agency during the contract term. Dividing efforts across multiple agencies can disrupt strategies, dilute results, and lead to suboptimal performance.

Engaging another marketing company or agency during the contract period will not absolve the Client of their obligations under this agreement.

Modifications and Termination

Creative 360 Pro reserves the right to modify or discontinue services at any time. Any changes will be communicated to the Client, and these Terms will remain in effect unless the contract is terminated in accordance with the cancellation policy.

Creative 360 Pro reserves the right to terminate the agreement if the Client breaches any of these Terms, including failure to make timely payments or initiation of chargebacks or disputes without prior resolution attempts.

Governing Law

This agreement is governed by the laws of the State of New Jersey. Any disputes arising from these Terms will be resolved exclusively in the courts of New Jersey.

Amendments

Creative 360 Pro reserves the right to amend these Terms at any time. Updated Terms will be communicated to the Client, and continued use of services constitutes acceptance of the changes.

Acknowledgment

By engaging the services of Creative 360 Pro, the Client confirms that they have read, understood, and unequivocally agreed to these Terms & Conditions. The Client acknowledges the no-refund policy and non-cancelable six-month contract commitment and agrees to the prohibition of chargebacks or third-party interference in contractual obligations.

1- SMS Consent Communication:

The Phone Numbers obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

2- Types of SMS Communications:

If you have consented to receive text messages from Creative 360 Pro, you may receive messages related to the following:

  • Reports 
  • Appointment Reminders
  • General Information

3- Message Frequency:

Message frequency may vary depending on the type of communication. You may receive up to 10 daily SMS messages depending on your engagement.

4- Potential Fees for SMS Messaging:

Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.  

5- Opt-In Method:

You may opt-in to receive SMS messages from Creative 360 Pro in the following way :

  • By submitting a website form

6- Opt-Out Method:

You can opt out of receiving SMS messages at any time. To do so, simply reply “STOP” to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list.
