Refund Policy for Creative 360 Pro

By accessing or utilizing the services of Creative 360 Pro (“we,” “us,” or “our”), you (“Client”) agree to be bound by the terms and conditions outlined in this Refund Policy. If you do not agree to these terms, you are not authorized to access or use our services.

1. Services Provided

Creative 360 Pro offers a wide range of digital marketing services, including but not limited to:

  • Website design and development
  • Search engine optimization (SEO)
  • Content creation and copywriting
  • Social media management
  • Paid advertising management (e.g., Google Ads, Facebook Ads)
  • Brand development and online marketing strategies

The specific details of services provided are outlined in individual agreements, proposals, or contracts, which vary based on the scope of each project.

2. Client Responsibilities

Clients agree to:

  • Provide accurate, up-to-date, and complete information required for the successful provision of services.
  • Respond promptly to requests for feedback, approvals, and any required content or materials.
  • Ensure that all materials provided (e.g., images, text, logos) do not infringe on the intellectual property rights of third parties.
  • Adhere to guidelines, instructions, or recommendations provided by Creative 360 Pro to achieve optimal results.
  • Cooperate and communicate in a timely manner to prevent unnecessary delays in service delivery.

Note: Creative 360 Pro is not responsible for marketing performance or results if the Client engages multiple marketing or SEO agencies simultaneously. SEO requires patience, consistency, and a unified strategy, and splitting efforts across multiple agencies can negatively impact results. Clients are advised to work exclusively with one marketing partner at a time.

Additionally, no third-party company or agency has the authority to cancel or modify the Client’s agreement with Creative 360 Pro. The Client acknowledges the binding nature of the 6-month commitment for SEO services and agrees that cancellations initiated by external parties, including other marketing agencies, will not be honored.

3. Payment Terms and Fees

  • Payment Terms: Payment schedules will be outlined in individual agreements. Timely payment is required to avoid suspension or termination of services.
  • SEO Services Contract: Clients agree to a 6-month commitment for SEO services, which cannot be canceled before the end of the term.
  • Website Design Services: Website design services require a non-refundable upfront payment. Once 24 hours of work have been completed, no refunds will be issued, and the remaining balance must be paid as per the service agreement.
  • Auto-Charge for Monthly Services: Ongoing services, including SEO, will be auto-charged monthly and continue until the agreed-upon contract term is fulfilled.

4. Cancellation and Refund Policy

  • Website Design Services:
    • Once work has commenced on a website design project, refunds are not available after 24 hours of labor. Clients remain responsible for the full payment as per the agreement.
    • Cancellation after this period does not entitle the Client to a refund.
  • SEO Services:
    • SEO requires a long-term commitment, with meaningful results typically visible within 5-6 months.
    • Clients agree to a minimum 6-month contract for SEO services, which cannot be canceled or refunded before the contract term is completed.
    • Creative 360 Pro does not guarantee specific rankings or immediate outcomes due to factors such as algorithm changes and market competition.
  • No Refunds After Work Begins:
    • Once work on any service has commenced, including SEO or website design, no refunds will be issued under any circumstances.
  • Early Termination or Cancellation:
    • If the Client cancels services before the end of the contract or after design work has started, no refunds or prorated payments will be provided.
    • Clients are responsible for any fees incurred up to the cancellation date.
    • Creative 360 Pro will not issue refunds or credits if services are terminated due to interference from a third-party marketing agency or another company.
  • Refund Eligibility:
    • Refunds may only be considered in exceptional cases where services were not rendered or were misrepresented. Clients are encouraged to discuss concerns directly with Creative 360 Pro before initiating disputes or chargebacks.

5. Chargebacks and Disputes

  • No Chargebacks: Clients agree not to initiate chargebacks with their payment provider once services have begun.
  • Dispute Resolution: Clients must communicate directly with Creative 360 Pro to resolve any concerns before initiating chargebacks.
  • Legal Action: In the event of a chargeback, Creative 360 Pro reserves the right to pursue legal action to recover fees, including additional costs incurred due to the chargeback process.

6. Confidentiality

  • Client Information: All information provided by the Client, including business strategies, marketing data, and proprietary materials, will remain confidential.
  • Company Information: Clients agree to respect the confidentiality of Creative 360 Pro’s proprietary information, including pricing models, strategies, and trade secrets.

7. Intellectual Property Rights

  • All intellectual property created by Creative 360 Pro during the project remains the property of Creative 360 Pro until full payment is received.
  • Upon full payment, ownership of intellectual property will transfer to the Client unless otherwise specified in the agreement.
  • Creative 360 Pro reserves the right to use anonymized data for analytical purposes and marketing (e.g., case studies) without disclosing confidential Client information.

8. Limitation of Liability

  • Creative 360 Pro is not liable for any indirect, consequential, or punitive damages resulting from the use or inability to use services provided.
  • In no event shall Creative 360 Pro’s liability exceed the total amount paid by the Client for the specific service.
  • SEO results depend on external factors, such as search engine algorithm changes, and Creative 360 Pro cannot guarantee specific outcomes or results within a defined timeframe.

9. Governing Law

This Refund Policy is governed by the laws of the State of New Jersey. Any disputes will be resolved exclusively in New Jersey courts.

10. Amendments

Creative 360 Pro reserves the right to update or modify this Refund Policy at any time. Changes will be communicated via email, and continued use of services constitutes acceptance of updated terms. Clients are encouraged to review the policy periodically.

11. Acknowledgment of Terms

By using Creative 360 Pro’s services, you confirm that you have read, understood, and agreed to this Refund Policy, including:

  1. The non-refundable nature of website design and SEO services once work has commenced.
  2. The binding 6-month SEO commitment, which cannot be canceled or altered by any third-party agency or external company.
  3. The advice to work exclusively with one marketing agency to ensure optimal results.
